Agreement to Terms

By accessing or using the services provided by Kingsway Drafting & Design ("Company," "we," "our," or "us"), you agree to be bound by these Terms of Service. If you do not agree to these terms, please do not use our services.

These terms apply to all visitors, users, and clients who access or use our website and services, including architectural drafting, permit management, interior design, and 3D rendering services.

Services Description

Kingsway Drafting & Design provides professional architectural drafting and design services, including but not limited to:

• Architectural drafting and design for residential and commercial projects
• Development Permit (DP) and Building Permit (BP) applications and management
• Interior design and space planning
• 3D rendering and visualization services
• As-built drawings and documentation
• Permit coordination with municipal authorities

Client Responsibilities

As a client, you agree to:

• Provide accurate and complete information necessary for your project
• Respond to requests for information or approvals in a timely manner
• Review and approve drawings and documents as required during the project
• Pay all fees and charges as agreed upon in the project proposal or contract
• Obtain any necessary permissions or approvals from property owners or authorities
• Comply with all applicable laws, regulations, and building codes

Project Proposals and Contracts

All projects are subject to a written proposal or contract that outlines the specific scope of work, deliverables, timeline, and fees. The proposal or contract, along with these Terms of Service, constitutes the entire agreement between you and Kingsway Drafting & Design.

Any changes to the scope of work must be agreed upon in writing and may result in additional fees and timeline adjustments.

Fees and Payment

Payment Terms

• Fees for services are outlined in the project proposal or contract
• A deposit may be required before work commences
• Progress payments may be required at specified milestones
• Final payment is due upon project completion or as specified in the contract
• All prices are in Canadian dollars unless otherwise specified

Late Payments

Late payments may be subject to interest charges as permitted by Alberta law. We reserve the right to suspend work on a project until outstanding payments are received.

Intellectual Property

Ownership of Drawings

Upon full payment, clients receive a license to use the drawings and designs for the specific project and property for which they were created. Kingsway Drafting & Design retains copyright and ownership of all original designs, drawings, and documents.

Restrictions

• Drawings may not be used for other properties or projects without written consent
• Drawings may not be modified or reproduced without authorization
• Designs may not be shared with or sold to third parties

Permits and Approvals

While we assist with permit applications and coordinate with municipal authorities, we cannot guarantee permit approval. Permit decisions are made by the relevant municipal or regulatory bodies. Additional fees may apply if permit applications require revisions or resubmissions due to municipal requirements beyond our control.

Limitation of Liability

To the maximum extent permitted by law:

• Our liability is limited to the fees paid for the specific services giving rise to the claim
• We are not liable for indirect, incidental, special, or consequential damages
• We are not responsible for delays or failures caused by circumstances beyond our control
• We are not liable for issues arising from inaccurate information provided by the client
• We are not responsible for construction defects or contractor performance

Indemnification

You agree to indemnify and hold harmless Kingsway Drafting & Design, its officers, employees, and agents from any claims, damages, losses, or expenses arising from your use of our services, your breach of these terms, or your violation of any rights of a third party.

Project Cancellation

If you wish to cancel a project:

• Written notice of cancellation is required
• Fees for work completed up to the cancellation date are non-refundable
• Deposits may be applied to work completed or retained as cancellation fees
• Any materials or partial deliverables may be provided at our discretion

Confidentiality

We treat all client information and project details as confidential. We will not share your information with third parties except as necessary to complete your project or as required by law.

Governing Law

These Terms of Service are governed by the laws of the Province of Alberta and the federal laws of Canada applicable therein. Any disputes arising from these terms or our services shall be resolved in the courts of Alberta.

Changes to Terms

We reserve the right to modify these Terms of Service at any time. Changes will be effective upon posting to our website. Continued use of our services after changes are posted constitutes acceptance of the modified terms.

Severability

If any provision of these Terms of Service is found to be unenforceable, the remaining provisions shall continue in full force and effect.
